1. This order shall dispose of one anticipatory bail petition, i.e., CRM-M-33143-2025, and two regular bail petitions, i.e., CRM-M-36811- 2025 and CRM-M-43295-2025, respectively, as all the petitions are interconnected and have arisen out of same FIR. CRM-M-33143-2025, has been filed by the petitioner - Amandeep Kaur, aged about 30 years, under Section 482 of the BNSS, 2023 (earlier Section 438 Cr.P.C.), for grant of anticipatory bail in case FIR No.127, dated 18.08.2024, under Sections 406/420/120-B of IPC, 1860 [Sections 316(1)/318(2)/61(2)/111/112 of BNS, 2023, added later on], registered at Police Station Sadar Jagraon, Ludhiana.
3. In the aforesaid anticipatory bail petition, on 23.06.2025, this Court, passed the following order:-
"1. Prayer in this petition, filed under Section 482 of the BNSS, 2023 (earlier Section 438 Cr.P.C.), is for grant of anticipatory bail to the petitioner, who has been booked in a criminal case arising out of First Information Report, as detailed hereunder:-

Complainant - Darshan Singh has got registered an FIR with the allegation that he has cheated upon Rs.15,70,000/- by (1) Narinder Purewal, (2) Parminder Singh, (3) Ravinder Kaur @ Harry, (4) Karamjeet Kaur, (5) Satwinder Singh, (6) Parminder Kaur, and (7) Mandeep Rai, by giving false assurance of getting merit and take him abroad (Canada). As per settled terms, total amount of Rs.27 lacs was to be paid to the petitioner's party for taking complainant to Canada and for the said purpose, marriage was required to be performed with the girl namely Mandeep Rai who is having PR of Canada. At best, it is alleged that it is violation of the terms settled in the midst of the agreement, which was executed happily by both the sides. No criminality is involved and therefore custodial interrogations would not be required as petitioner is ready to join investigation.
3. Additionally, it is submitted that, even as per the allegations levelled, neither a single penny stands credited to the bank account of the petitioner, nor has any amount been paid to him directly in cash.
Thus, prays for grant of concession of anticipatory bail to the petitioner in the present case.

5. On advance notice, learned State counsel puts in appearance on behalf of the respondent - State, and seeks some time to respond to the submissions addressed by learned counsel opposite, after seeking instructions. And, in case of necessity, to file status report.
6. Adjourned to 18.09.2025.
7. In the meanwhile, the petitioner is directed to join the investigation as and when required to do so by the Investigating Agency. In the event of his arrest, the petitioner shall be released on ad-interim bail, subject to his furnishing bail bonds to the satisfaction of the Arresting Officer. The petitioner shall also be abide by all the conditions laid down under Section 482(2) of BNSS, 2023 (earlier Section 438(2) Cr.P.C.).
8. Besides, it is directed that petitioner would hand over his passport to the Investigating Agency or to Court concerned, if he possesses. Otherwise, would submit an affidavit, disclosing the fact that he does not possess any passport.
It is also directed that before leaving country any time during trial, petitioner would seek prior permission of the Court."
4. Continuing his submissions, learned counsel for the petitioner contends that in compliance of the order dated 23.06.2025, passed by this Court, petitioner has joined the investigation, and has fully co-operated. Therefore, he prays for confirmation of the said interim anticipatory bail order.
5. Learned State counsel on instructions, confirms the said averment made by learned counsel for the petitioner of joining the investigation by the petitioner, and submits that as of now, custodial interrogation of the petitioner is not required for the purpose of investigation.
6. Since, petitioner has already joined the investigation and custodial interrogation is no more required; ad-interim bail order dated 23.06.2025, passed by this Court is hereby made absolute. Accordingly, CRM-33143-2025 is allowed.
However, petitioner shall continue to join the investigation as and when required to do so and abide by all the terms and conditions laid 3 of 7 ::: Downloaded on - 13-11-2025 12:13:12 ::: CRM-M-33143-2025 & CONNECTED CASES -4- down under Section 482(2) of BNSS, 2023.

Petitions CRM-M-36811-2025 and CRM-43295-2025, have been filed by the petitioners, namely; Karamjit Kaur alias Kamo and Narinder Purewal, respectively, under Section 483 of BNSS, 2023 (earlier Section 439 Cr.P.C.), for grant of regular bail, during the pendency of trial, who have been booked in a criminal case, i.e., FIR No. 127, dated 18.08.2024, under Sections 406, 420, 120-B of IPC, 1860 [Sections 111/112 of BNS, 2023 added later on], registered at Police Station Sadar Jagraon, District Ludhiana.
8. In regard to the aforesaid two regular bail petitions, facts are being reiterated once again, which are as under:-
"Complainant - Darshan Singh, has got registered FIR in question with the allegation that he has been cheated upon for a sum of Rs.15,70,000/- by (i) Narinder Purewal, (ii) Parminder Singh, (iii) Harvinder Kaur Harry w/o Jasvir Singh, (iv) Karamjit Kaur w/o Tarsem Singh, (v) Satvinder Singh s/o Tarsem Singh, (vi) Parminder Kaur w/o Satvinder Singh, and
(vii) Mandeep Kaur Rai, by giving false assurances of getting married and to take him to abroad (Canada). As per settled terms, total amount of Rs.27,00,000/- was to be paid to the petitioners for taking the complainant to Canada and for the said purpose, marriage was required to be performed with the girl, namely; Mandeep Kaur Rai, who is having PR of the Canada.
Additionally, it is also submitted that as per allegation, an amount of Rs.15,70,000/- has been paid to the accused persons, but in fact, except an amount of Rs.1,50,000/- in the account of 4 of 7 ::: Downloaded on - 13-11-2025 12:13:12 ::: CRM-M-33143-2025 & CONNECTED CASES -5- son of Karamjit Kaur alias Kamo (petitioner in CRM-M-36811- 2025), nothing has been paid. Even the said amount has also been paid back, as stated by learned counsel for the petitioner - Karamjit Kaur alias Kamo."
9. Learned counsel for the petitioners in CRM-M-36811-2025 and CRM-M-43295-2025, submit that there is no written agreement in regard to the allegations between the parties. The investigation has already been completed and the petitioners are inside jail since August 2024. Out of total 18 prosecution witnesses, none has been examined so far. Besides, all the offences are triable by the Court of learned Magistrate.
Further submits that there are very bleak chances of culmination of trial in the near future, thus, learned counsel pray for concession of regular bail to the petitioners.
10. On the other hand, learned State counsel has filed the status report dated 29.09.2025 in CRM-M-36811-2025 and status report dated 18.09.2025 in CRM-M-43295-2025 in Court today, which are taken on record, subject to all just exceptions. Office to tag the same at appropriate place.
Copies thereof have been handed over to the counsel for the petitioner.

Learned State counsel submits that the petitioners duped the complainant of a sum of ₹15,70,000/- on the pretext of sending him abroad (to Canada) by performing a fake marriage, and that they were actively involved in the commission of the offence. Thus, keeping in view the gravity of offence and nature of the allegations, they do not deserve any leniency.
However, the factual position asserted by the petitioners' 5 of 7 ::: Downloaded on - 13-11-2025 12:13:12 ::: CRM-M-33143-2025 & CONNECTED CASES -6- counsel and noticed here-above is not disputed by learned State counsel. It is also an admitted position that out of a total of 18 prosecution witnesses, not even a single witness has been examined so far, despite the petitioners having remained under incarceration since August 2024.

Taking into consideration the totality of the facts and circumstances, that:- (a) petitioners Karamjit Kaur @ Kammo and Narinder Purewal, have suffered incarceration inside jail for the last about 01 year and 02 months period; (b) out of total of 18 prosecution witnesses, none has been examined so far, indicating that the pace of trial is evidently slow and its conclusion is likely to take considerable time; (c) all the offences in question are triable by the Court of the learned Magistrate; and (d) nature of allegations levelled against the petitioners are yet to be proved; this Court deems it appropriate to extend the concession of regular bail to the petitioners.
13. Consequently, prayer made in the petitions, i.e., CRM-M-36811- 2025 and CRM-M-43295-2025 are allowed. Petitioners are ordered to be released on bail, subject to their furnishing bail/surety bonds to the satisfaction of the learned trial Court/ Chief Judicial Magistrate/ Illaqa Magistrate/ Duty Magistrate concerned, if not required in any other case.
14. Needless to observe that the petitioners shall not extend any threat and shall not influence any prosecution witness in any manner directly or indirectly.
15. The observation made here-in-above shall not be construed as an expression of opinion on the facts of the case and the Trial Court is expected to decide the case on the basis of complete evidence available on record.
16. Petitions stand disposed of accordingly.
