ORAL ORDER
4 14-07-2015Heard learned counsel for the petitioner and learned A.P.P. for the State.
The petitioner seeks bail in a case registered for the offence punishable under Sections 302, 307, 379, 427, 435, 326, 353, 324, 147, 148 149 of the Indian Penal Code, Section 27 of the Arms Act, Sections ¾ of the Explosive Substance Act, section 17 of the Criminal Law Amendment Act and Sections 10, 17, 18, 19 and 20 of the Unlawful Activities (Prevention) Act, 1967.
It is submitted by the learned counsel for the petitioner that name of the petitioner has appeared in the confessional statement of the co-accused Rajendra Yadav and later on the petitioner has confessed his guilt in the custody of the police and his name has also appeared in the confessional statement of other co-accused, as mentioned in paras 160, 241, 169 and 296 of the case diary. There is no eye witness to the 2 Patna High Court Cr.Misc. No.41937 of 2014 (4) dt.14-07-2015 2/2 occurrence. In similar circumstances, Ramashish Paswan and Shabir Paswan have been granted bail vide Cr. Misc. no. 17333 of 2014.
Learned counsel for the State could not controvert the contention of the petitioner while opposing the prayer for bail.
Considering the facts and circumstances, the above named petitioner is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand only) with two sureties of the like amount each to the satisfaction of learned S.D.J.M., Daudnagar, District-Aurangabad in Goh P. S. Case No. 140 of 2013 with following conditions:-
1. The petitioner will not indulge himself in similar or any other offence.
2. One of the bailors must be the close relative of the petitioner.
3. The petitioner will be well represented in the Court on each and every date and in case of absence for two consecutive dates or in case of violation of terms of bail, his bail bond would be liable to be cancelled by the learned Court concerned.
