CRIMINAL REVISION CASE No.2765 OF 2016
ORDER:
The present Criminal Revision Case is filed under Sections 397 read with 401 Cr.P.C. questioning the judgment dated 01.09.2016 passed in Criminal Appeal No.30 of 2016 on the file of the Principal Sessions Judge, Mahabubnagar, wherein the learned Sessions Judge modified the confiscation order to the extent of 10% of the seized stock.
A perusal of the impugned judgment would show that the learned Sessions Judge on one hand held that the order of confiscation does not stand legal scrutiny of law and against the circular issued by the Government in the year 2007, but on the other hand, in the last portion of the judgment, it is stated that "modifying the order of confiscation to the extent of 10% of seized stock".
Having regard to the facts and circumstances of the case, the Criminal Revision Case is allowed and the last portion of the impugned judgment i.e., "modifying the order of confiscation to the extent of 10% of seized stock" is hereby set aside.
Miscellaneous petitions, if any, pending shall stand closed.
