1. Learned counsel for the petitioner submits that the respondent had originally issued a notice under Section 10 of Indo-Tibetan Border Police Force Act, 1992 read with Rule 19 of the Indo-Tibetan Border Police (ITBP) Rules 1994, which empowers Central Government to terminate the services of an officer on the ground of unsuitability.

2. Learned counsel submits that Rule 19(3) of the ITPB Rules requires the Central Government to first call upon the officer to retire or resign and W.P.(C) 8906/2022 1 This is a digitally signed order.

The Order is downloaded from the DHC Server on 12/12/2023 at 00:19:54 on his refusing to do so, the officer may be compulsory retired from the service. He submits that since the petitioner has today completed 20 years of service, he is willing to exercise the power given under Rule 19(3) of the ITPB Rules and seek voluntary retirement from the said service.
