Advocates for both sides contended that the issues involved in both the Appeals are identical and no separate consideration is required and, therefore, no separate argument was being advanced. Thus, in view of our judgement of date in SC/322/A/2007, this Appeal is also allowed and the impugned judgement is set aside and the complaint is dismissed. No order as to cost.
