Heard Sri Somesh Tripathi, learned counsel for the applicant and Sri Ankit Kumar, Advocate holding brief of Sri Ratnesh Chandra, learned counsel for the respondent.
This is an application under Section 11(6) of the Arbitration and Conciliation Act, 1996 for appointment of Arbitrator.
This Court had proposed the name of arbitrator by means of order dated 18.04.2019,the operative portion of which reads as under:-
"n view of Sub-section 6-A of Section 11 of the Act, 1996 the name of Hon'ble Mr. Justice Sanjay Harkauli (Retd.) is proposed for appointment as an Arbitrator to resolve the dispute arising out of agreement between the parties.
Let a copy of the pleadings on record alongwith the relevant provisions of the amending Act 2015 be sent to Hon'ble Mr. Justice Sanjay Harkauli (Retd.) R/o Flat No.- 912, F-8, Sagar Presidency, Section- 50, Noida seeking his consent and disclosure in terms of Section 11(8) read with Section 12(1) of the Act, 1996 as amended by the Arbitrator & Conciliation (Amendment) Ordinance 2015 and the Schedule-VI appended thereto.
The Arbitration shall be held at Lucknow."
In pursuance of the aforesaid order Hon'ble Mr. Justice Sanjay Harkauli (Retd.) has furnished the disclosure and accorded his consent in terms of Section 12 of the Act of 1996 and to be an Arbitrator vide letter dated 28.05.2019.
In view of above, Hon'ble Mr. Justice Sanjay Harkauli (Retd.) is appointed as an Arbitrator to arbitrate with regard to the dispute between the parties herein.
The application is disposed of accordingly.
Office is directed to communicate a copy of this order to Hon'ble Mr. Justice Sanjay Harkauli (Retd.) forthwith.
