ORDER:

1. The appellants were employed as Judgment Writers and were allowed to switch over to ministerial cadre as Superintendent Grade-II. According to the appellants, this course was admissible under the Shetty Commission report, subject to minimum period of service in the cadre of Stenographers being available and being laid down by the High Court. The order of switch over has been set aside by learned Single Judge on the ground that no minimum service period has been laid down so far. However, direction was issued that such minimum period be laid down expeditiously.

2. Only contention raised on behalf of the appellants is that they have already completed 23 to 26 years of service, which will be far in excess to minimum period that may be laid down and in such a situation, pending decision on laying down of minimum period, status quo be maintained.

3. In view of above, we direct that status quo with regard to position of the appellants be maintained for a period of three months, in which period the direction in the impugned order might be complied with.

4. The appeal is disposed of accordingly. It is, however, made clear that any of the respondents will be at liberty to move this Court, if aggrieved.
