                   WRIT PETITION No.381 OF 2024

ORDER:

Aggrieved by the action of respondent No.5 in issuing the impugned proceedings No.HO/HO/ME/MEDA/POCO/0989, dated 21.12.2021, duly allotting the petitioner to Medak District contrary to his option exercised to Sangareddy District, the present writ petition is filed.

2. Heard Sri Mogili Anaveni, learned counsel for the petitioner and Sri M.V. Rama Rao, learned Special Government Pleader for Home, appearing for respondent Nos.2 to 5.

3. Learned counsel appearing for the petitioner submitted that the petitioner was appointed as Police Constable (Civil) on 22.12.2012 and he was posted to Medak District. While so, after bifurcation of Districts in the State, the Government has issued G.O.Ms.No.317, General Administration (SPF-I) Department, dated 06.12.2021, regarding allotment of employees to new local cadres and further guidelines have been issued in Memo No.1655/SPF-I/2021-6, dated 22.12.2021 and Circular Memo No.1655/SPF-I/2021-7, dated 23.12.2021, and in pursuance of the same, the petitioner was allotted to Medak District vide impugned proceedings, dated 21.12.2021, contrary to his option exercised to Sangareddy District. It is further submitted that the petitioner's wife who was working as Agriculture Extension Officer at Zaheerabad Mandal, Sangareddy District, is allotted to Zone VI-Charminar. Therefore, the petitioner has submitted 2 PK,J wp_381_2024 an appeal to the concerned authorities on 10.03.2022, challenging the impugned allotment order, date 21.12.2021, and requested to allot him to Sangareddy District on spouse grounds. However, the said appeal is still pending before the respondents. Therefore, learned counsel for the petitioner prayed this Court to pass necessary orders in the present writ petition.

Learned Special Government Pleader for Home, appearing for respondent Nos.2 to 5, submitted that there is no clear endorsement on the appeal of the petitioner and further submitted that the respondents will consider the appeal of the petitioner, if the same is received by them, and dispose of the same in accordance with law.

5. Having regard to the rival submissions made by the respective parties, without going into merits of the case, the Writ Petition is disposed of with a direction to respondent No.2 to consider the appeal of the petitioner, dated 10.03.2022, if so received, and pass appropriate orders thereon, in accordance with law, within a period of six (06) weeks from the date of receipt of a copy of this order, and communicate a copy thereof to the petitioner.

Interlocutory applications, if any, pending in this writ petition, shall stand closed. No costs.
