Learned counsel submits that the controversy involved in this case has otherwise been decided by this court in the case of Pawan Kumar Bardiya & ors Vs State of Rajasthan & anr, SB Civil Writ Petition No. 8046/2008, decided on 18.8.2011. Therein, it was held that if a candidate is overage than prescribed under the Rules, he would not be entitled for consideration of selection unless relaxation is granted by the government. Accordingly, petitioners were given liberty to make representation to the government for grant of relaxation in age. It is prayed that similar order may be passed herein, rather, writ petition may be covered by the aforesaid judgment. Petitioner will accordingly submit a representation, which may then be considered by the respondents.

In view of submission made, this writ petition is disposed of with liberty to the petitioner to make a representation to the respondents for grant of age relaxation then aforesaid representation would be considered in the light of the observations made by this court in the case of Pawan Kumar Bardiya(supra). Petitioner will accordingly enclose a copy of the said judgment along with the representation. Consideration of the representation may be made within shortest possible time, if possible, within a period of one month from the date of receipt of copy of this order.
