1. None appears for the petitioner.
2. Respondent No.2 has moved an application that his application under Section 456 (2) Cr.P.C. for getting the possession was not decided and remained pending. When respondent No.2 moved a fresh application, Court refused to pass an order, as earlier application was pending.
3. It is prayed that the record of the Court below be returned forthwith so that appropriate order may be passed on application under Section 456(2) Cr.P.C. filed by the respondent No.2.
4. Considering the prayer made before the Court, it is directed that the record of the Court below be returned forthwith, with a direction to the Court below to pass order on the application filed by the respondent No.2 and thereafter, to return the record.
5. Application is accordingly disposed.
