JUDGMENT
MANMOHAN, J (Oral):
The petition has been heard by way of video conferencing. Though the present writ petition has been filed with a very elaborate prayer clause, yet learned counsel for the petitioners confines his prayer for convening a DPC to fill up the fifteen anticipated vacancies coming up in the year 2021. He further prays that the petitioners' representation dated 28th September, 2020 with regard to eight unfilled vacancies of DIG reserved for IPS Officers, which are lying vacant for more than ten years, be decided forthwith. He states that if the petitioners' representation is allowed, the aforesaid eight vacancies should be diverted to the promotee quota and DPC be held and officers be promoted from Second-in-W.P. (C) 2682/2021 Page 1 of 2
Commandant (2I/C) to Commandant, Commandant to DIG.
Issue notice. Ms.Aakanksha Kaul, Advocate accepts notice on behalf of the respondents.
Keeping in view the order dated 04th August, 2020 passed in W.P.(C) No.3443/2020, this Court directs the respondents to hold a DPC for second in commandant (2I/C) to Commandant, Commandant to DIG, DIG to IG and IG to ADG for fifteen anticipated vacancies coming up in the year 2021 and to promote the candidates, if found entitled for promotion, within six weeks from today.
The respondent no.1 is also directed to decide the petitioners' representation dated 28th September, 2020 by way of a speaking order within six weeks. In the event, petitioners' representation dated 28 th September, 2020 is decided in their favour and the eight unfilled vacancies of DIG reserved for IPS Officers are diverted to the promotee quota, the DPC shall be convened for such diverted posts within six weeks thereafter and officers be promoted from Second-in-Commandant (2IC) to Commandant, Commandant to DIG.
With the aforesaid directions, present writ petition along with pending application stand disposed of.
