2 14-03-2012Heard learned counsels for the petitioner and the State.
The petitioner is languishing in custody since 29.11.2011 in a case registered under Sections 376g and 120B of the Indian Penal Code.
It is alleged against the petitioner that on his call the victim went when others established forceful physical relationship. In 164 Cr.P.C. statement, the victim girl stated that when the offence was committed, the petitioner, with whom she was in love, did not rescue her rather facilitated the offence to be committed.
It is submitted by learned counsel for the petitioner that the investigation is complete.
Considering the fact that the accusation of establishing forceful physical relationship is not against the 2 Patna High Court Cr.Misc. No.7661 of 2012 (2) dt.14-03-2012 2/2 petitioner, let the above named petitioner be released on bail, on furnishing the bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Darbhanga in connection with Sadar P.S. Case No. 444 of 2011.
