JUDGMENT
1. Vide this judgment, the present petition filed by petitioner namely Ms. Sonia Daga for grant of succession certificate in her favour qua the debt and securities in the name of Late Sh. Brijendra Mohan Aggarwal @ Brijindra Mohan Aggarwal @ Brijender Mohan Aggarwal @ B.M Aggarwal with the company concerned in the form of balance credits, shall be disposed of.
2. In the petition, it is inter-alia pleaded that Late Sh. Brijendra Mohan Aggarwal @ Brijindra Mohan Aggarwal @ Brijender Mohan Aggarwal @ B.M Aggarwal who passed away intestate on 05.09.2007, was the father of petitioner and respondent no.3 and 4 and husband of respondent no.2. It has been further pleaded that the ordinary place of residence of the deceased at the time of his death was at East of Kailash, which falls within the territorial jurisdiction of this Court. It has been further pleaded that vide judgment dated 03.08.2000, the deceased had succeeded to 1/6 th share in assets of his mother Late Smt. Kailashwati. It has been further added that, since the deceased has expired, petitioner and respondent no.2 to 4 are now entitled to 1/4 th share each in the Succ. Court No. 134/24 Sonia Daga Vs. It has been further pleaded that in November 2022, the petitioner and respondent no.2 to 4 got to know about shareholdings lying unclaimed in name of the deceased. Therefore, the deceased has left behind certain movable assets in form of shareholdings with various companies, which have been mentioned in Schedule A of the present petition. It has been pleaded that the deceased has left behind the petitioner and respondent no. 2,3 and 4 as his only Class-I legal heirs.
3. The record of the Court file reflects that the general notice of this petition was given to public by way of publication in the newspaper "Veer Arjun" on 11.10.2024. In response to the said notice, no person from the general public came forward to offer any objection(s) qua grant of succession certificate to the petitioner.
4. During the summary proceedings conducted as per Section 373 of the Indian Succession Act, 1925, 08 witnesses were examined.
5. Through her testimony, PW-1 Ms. Sonia Daga tendered her evidence by way of affidavit Ex.PW-1/A and she relied upon the following documents:

Manager, DSIDC, Okhla Industrial Area, New Delhi brought the details pertaining to 2000 and 370 shares of DCM Shriram Ltd. bearing Folio no. 00006236 & 00004093 respectively, in name of the deceased. He further deposed that as per the report, the amount payable for the said shares is Rs. 21,38,000/- & Rs. 3,95,000/- respectively as on 17.04.2025. His report is Ex.PW1/A. Succ. 7. Further, PW-2 Sh. Shilendra Kumar Pathak, Asst. Manager, DSIDC, Okhla Industrial Area, New Delhi brought the details pertaining to 6650 shares of DCM Shriram Ltd. bearing Folio no. 00019821 in name of Smt. Kailash Wati. He further deposed that as per the report, the amount payable for the said shares is Rs. 92,63,450/- 21.07.2025. His report alongwith authority letter is Ex.PW2/A (colly).
8. Further, PW-3 Sh. Kishori Prasad, Executive (Account & Finance) DCM Ltd., Bara Hindurao, New Delhi brought the details pertaining to 665 shares of DCM Shriram Ltd. bearing Folio no. K0005912 in name of Smt. Kailash Wati. He further deposed that as per the report, the amount payable for the said shares is Rs. 76,475/- as on 21.07.2025. He also brought details pertaining to 173 shares under Folio No. B0000124 & B0004070 in name of Brijender Mohan Aggarwal and the valuation of the same is Rs. 19,895/-. His report alongwith authority letter is Ex.PW3/A (colly).
9. Further, PW-4 Sh. Jagdish Kumar, Data Operator, Skyline Financial Services Pvt. Ltd., brought the details pertaining to 25 & 148 shares under Folio No. B0000124 & B0004070 respectively, in name of Brijender Mohan Aggarwal. He also brought report pertaining to 1330 shares under Folio No. K0005912 in name of Smt. Kailash Wati. His report is Ex.PW4/A (colly).

He also brought report pertaining to 732 & 104 shares under Folio No. 0019821 in name of Smt. Kailash Wati. He further deposed that the valuation of the aforesaid shares is around Rs. 93,632/- as on 26.08.2025. His report is Ex.PW5/A (colly).
11. Further, RW-1 Sh. Jai Bhagwan, Patwari, SDM office, Hauz Khas, New Delhi brought the legal heir report qua deceased Late Sh. Bijender Mohan Aggarwal and the same is Ex.RW1/A (colly).
12. Further, RW-3 Sh. Ankush Aggarwal deposed that he is respondent no.3 in the present matter and also Power of Attorney Holder for respondent no.2 Ms. Manju Aggarwal. He further deposed that petitioner is his real sister and that he and respondent no.2 do not have any objection if succession certificate in the present matter is issued in favour of the petitioner. Copy of his Aadhar card is Ex.RW3/1 (OSR) and Power of Attorney executed on behalf of respondent no.2 is Ex.RW3/2.
13. Further, during the course of trial, respondent no.4 Ankul Aggarwal had appeared before the court through virtual mode and he had been duly identified by counsel for petitioner. He stated that he does not have any objection if succession certificate Succ. Court No. 134/24 Sonia Daga Vs. State NCT of Delhi Page No. 13/20 Digitally signed by TARUNPREET TARUNPREET KAUR KAUR Date: 2025.11.21 15:05:37 +0530 in the present matter is issued in favour of the petitioner.
14. The entire record as well as the testimonies of the witnesses have been perused. Final arguments addressed by counsel for petitioner have been heard. Valuation report has been filed on behalf of petitioner.
15. Perusal of legal heir report Ex.RW1/A shows that Ms. Sonia Daga (petitioner, daughter), Smt. Manju Aggarwal (respondent no.2, wife), Sh. Ankush Aggarwal (respondent no.3, son) and Sh. Ankul Aggarwal (respondent no.4, son) are the only Class I legal heirs of the deceased. Further, there is no impediment to issuance of succession certificate in favour of petitioner and also, no one came forward to oppose issuance of succession certificate despite publication in newspaper.

Therefore, in view of Ex.RW1/A and NOC given by respondent no. 2,3 and 4, it is hereby ordered that succession certificate be issued in favour of petitioner namely Ms. Sonia Daga qua the debts and securities in name of Late Sh. Brijendra Mohan Aggarwal @ Brijindra Mohan Aggarwal @ Brijender Mohan Aggarwal @ B.M Aggarwal and Smt. Kailash Wati, which are as under :

17. The succession certificate shall be considered only as an entitlement of the petitioner to receive the amount (with applicable interest till date, if any) due towards Late Sh.
