1. This application is to condone the delay of 249 days in filing the present appeal against the order passed by the learned Single Judge in Special Civil Application No. 2796 of 2015.

2. Heard learned counsel for the applicant and also learned counsel for the respondent.

3. We have also perused the reasons stated in the petition to condone the delay. The learned counsel appearing for the respondent contends that order is already complied and therefore Page 1 of 2 HC-NIC Page 1 of 2 Created On Fri Sep 02 00:04:27 IST 2016 C/CA/6610/2016 ORDER there is no reason to condone the delay. Merely because order of the learned Single Judge is complied with, by itself is no reason to reject the application for condonation of delay in filing the appeal.

4. Looking to the reasons stated in the petition, we are satisfied that sufficient reasons are stated to condone the delay. Accordingly, delay is condoned. Civil application is allowed as prayed for.
