RAMESHWAR SINGH MALIK, J Feeling aggrieved against the alleged inaction on the part of respondent authorities, the petitioner has approached this court by way of instant petition, under Articles 226/227 of the Constitution of India, seeking a writ in the nature of Mandamus.
Learned counsel for the petitioner submits that when the grievance of the petitioner was not being redressed, it finally approached respondent no.6 vide legal notice 20.8.2013 (Annexure P-1), but the same is also pending decision. He further submits that the petitioner will be satisfied, in case respondent no.6 is directed to consider and decide the legal notice of the petitioner, within a reasonable time.
Having heard learned counsel for the petitioner and without expressing any opinion on the merits of the case, including the issue of Sahni Greesh 2013.10.21 12:37 I attest to the accuracy and integrity of this document High Court, Chandigarh CWP No.22757 of 2013 2 limitation, if any, The Executive Engineer,Bari Doab Drainage Division, Canal Office, Opposite Albert Road, Amritsar-respondent no.6 is directed to look into the matter, consider the grievance raised by the petitioner, vide its legal notice dated 20.8.2013 (Annexure P-1) and decide the same at an early date, by passing an appropriate order, in accordance with law, keeping in view the orders contained in Annexures P-3 to P-8, but in any case within a period of one month from the date of receipt of a certified copy of this order.
If, after consideration of the matter, respondent no.6 comes to the conclusion that the petitioner is entitled for the payment in question, the same shall be released in favour of the petitioner, without any further loss of time.
With the observations made above, the present writ petition stands disposed of.
