Bench: P. Sathasivam, V. Dhanapalan
JUDGMENT P. Sathasivam, J.
1. The above Writ Appeal has been filed against the order of the learned single Judge, dated 07.12.1998, made in W.M.P. No. 20993 of 1998 in W.P. No. 21142 of 1994.
2. It is not in dispute that questioning the order of the Principal Labour Court, Chennai, dated 27.01.1994, made in I.D. No. 490 of 1990, granting the relief of reinstatement with back wages in favour of the first respondent herein, the Commissioner of Collegiate Education and the Principal, Loganathan Narayanaswamy Government College, filed W.P. No. 21142 of 1994. Pending Writ Petition, they sought for stay of the order of the Labour Court. While considering the same, taking note of the provisions of Section 17B of the Industrial Disputes Act, the learned Judge directed the Writ Petitioners to deposit a sum of Rs. 1,00,000/- with the Labour Court, Chennai, within a period of twelve weeks. In the same order, the learned Judge directed the Labour Court to invest the said amount in a Nationalised bank. The workman/first respondent herein, viz., N. Janakiraman, was permitted to withdraw interest on the said amount once in six months. Apart from the said direction, the learned Judge also directed the Management to pay at the rate of Rs. 850/- per month in favour of the workman from the date of writ petition till its disposal.
3. In view of the order of the Labour Court and the provisions of Section 17B of the Industrial Disputes Act, we do not find any ground for interference. Accordingly, the Writ Appeal fails and the same is dismissed.
