Petitioner-Gurpeet Singh alias Laadi has filed this petition under Section 439 of the Code of Criminal Procedure, 1973 for grant of interim regular bail in case FIR No.137 dated 08.07.2017, registered at Police Station City South, Moga, District Moga, under Section 15 of the Narcotic Drugs and Psychotropic Substances Act, 1985 (for short, 'N.D.P.S. Act').
Notice of motion was issued. Learned State counsel has appeared and filed reply on behalf the respondent-State in Court today. Same is taken on record. He contested the instant petition.
I have heard learned counsel for the petitioner as well as learned State counsel and gone through the record.

In reply filed by the State, it is specifically stated that Manjit Kaur, wife of the petitioner, fell down from Activa Vehicle and received injuries including knee injury and she is under treatment at Rajeev Hospital, Moga. It is also stated that the doctor advised her to take complete bed rest for one month w.e.f. 04.08.2017 and the said period has already expired on 04.09.2017. It is also stated that the petitioner and his wife are residing in rental house and there is no permanent residence of the petitioner and his wife and if the petitioner is released on interim regular bail, there is every chance that he may abscond by misusing the concession of bail.
Keeping in view the reply filed by the State, I do not find any ground to grant interim regular bail to the petitioner. Furthermore, as per the prosecution version, recovery effected from the present petitioner falls in commercial quantity. Section 37 of the N.D.P.S. Act bars the grant of bail to the accused in case of commercial quantity.
Therefore, from the above, finding no merit in the present petition, the same is dismissed.
