Heard the learned counsel for the petitioners and the learned A.P.P. for the State.

The petitioners seek bail in a case for the offence punishable under Sections 147, 148, 149, 341, 323, 324, 307, 379 and 504 of the Indian Penal Code.

Considering the allegation against petitioner no. 1, Ramkhelawan Ram, that he gave dabiya blow to the informant twice on his head, his prayer for bail is rejected at this stage.

Petitioner no. 2, Surya Narayan Ram, is the order giver. There is no allegation of assault against him. He has no criminal antecedent.

Considering the facts and circumstances of this case, the above-named petitioner no. 2 is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Sub-Divisional Judicial Magistrate, Birpur at District Supaul in Raghopur P. S. Case no. 138 of 2014 with the following Patna High Court Cr.Misc. No.11383 of 2015 (3) dt.08-05-2015 2/2 conditions :

1. One of the bailors will be the close relative of the petitioner.
2. The petitioner will not indulge in similar or in any other offence.
3. The petitioner will be well represented in the court.
4. In case of absence for two consecutive dates or in violation of the terms of the bail, his bail bond will be liable to be cancelled by the court concerned.
