Notice of motion.

Mr.H.S.Brar, learned Additional Advocate General Punjab, accepts notice on behalf of the respondent-authorities-PUDA.

In view of the nature of order which I propose to pass there is no need to seek any counter reply from the respondents at this stage.

Let three copies of the writ petition be handed over to learned counsel for the respondent-authorities during the course of day.

The petitioner-company seeks a mandamus to direct the respondent-authorities to change its name in their official records in respect of plot No.A-13, Industrial Area, Phase-VI, S.A.S. Nagar, Mohali. It is averred that initially the Company was incorporated in the name of M/s Indiana Alloys and Forgings Limited. The company applied and was C.W.P.No.23208 of 2010 2 allotted the above stated plot by the PUDA. It is further averred that in its 8th Annual General Meeting (Annexure P-2), the Company decided to change its name from M/s Indiana Alloys and Forgings Limited to M/s Euro Scaff (India) Limited, namely, the present name. Since the petitioner had applied for the plot in its former name, the Conveyance Deed dated 16th February, 2000 was also executed in the old name of M/s Indiana Alloys and Forgings Limited. The petitioner-Company has been after obtaining the fresh certificate of incorporation dated 10.3.2000 (Annexure P-3), repeatedly representing the authorities for the change of its name in their records and send the future correspondence on its correct name and new address. It is further alleged that despite repeated representations, no action is being taken and the records of the respondent-authorities are still being maintained in the old name of the petitioner-Company.

Having heard learned counsel for the parties and considering the nature of relief sought in this writ petition, I deem it appropriate to dispose of the same with a direction to respondent Nos.2 & 3 to consider the above stated claim of the petitioner-Company regarding change of its name in the records of the PUDA authorities and pass an appropriate order within a period of two months from the date of receiving a certified copy of this order, in accordance with law/Rules/Bye-laws.

Ordered accordingly.
