COMMON PRAYER: Criminal Original Petitions are filed under Section
528 of Bharatiya Nagarik Suraksha Sanhita/Section 482 Cr.P.C., to call for
the entire records and quash the proceedings in Crime Nos.83 of 2018, 109
of 2017, 84 of 2018 and 24 of 2018, pending on the file of the first
respondent Police.

COMMON ORDER
These Criminal Original Petitions have been filed seeking to quash the proceedings in Crime Nos.83 of 2018, 109 of 2017, 84 of 2018 and 24 of 2018, pending on the file of the respondent Police.
2(i). The case of the prosecution in Crl.O.P.No.2124 of 2026 is that on 03.04.2018, the petitioner and others, who belong to a political party, without obtaining prior permission, had unlawfully conducted a meeting and a large procession, thereby causing disturbance to the public. Therefore, a case in Crime No.83 of 2018 was registered by the first respondent Police for the offences under Sections 341, 143 and 188 IPC. 2/6 https://www.mhc.tn.gov.in/judis ( Uploaded on: 09/02/2026 03:00:00 pm ) Crl.O.P.Nos.2124, 2129, 2150 & 2152 of 2026 2(ii). The case of the prosecution in Crl.O.P.No.2129 of 2026 is that on 25.04.2017, the petitioner and others, who belong to a political party, without obtaining prior permission, had unlawfully conducted a meeting and a large procession, thereby causing disturbance to the public. Therefore, a case in Crime No.109 of 2017 was registered by the first respondent Police for the offences under Sections 341, 143 and 188 IPC.
2(iii). The case of the prosecution in Crl.O.P.No.2150 of 2026 is that on 05.04.2018, the petitioner and others, who belong to a political party, without obtaining prior permission, had unlawfully conducted a meeting and a large procession, thereby causing disturbance to the public. Therefore, a case in Crime No.84 of 2018 was registered by the first respondent Police for the offences under Sections 341, 143 and 188 IPC.
2(iv). The case of the prosecution in Crl.O.P.No.2129 of 2026 is that on 29.01.2018, the petitioner and others, who belong to a political party, without obtaining prior permission, had unlawfully conducted a meeting and a large procession, thereby causing disturbance to the public. Learned counsel appearing for the petitioners submitted that the facts of the instant case are similar to the facts of the cases in Jeevanandham and others vs. The Inspector of Police, Velayuthampalayam Police Station, Karur District reported in (2018 2 LW (Crl) 606) and Sri Raja vs Inspector of Police, Sivakasi Town Police Station Virudhunagar District and others (Crl.O.P(MD) No.7922 of 2019, decided on 30.08.2019), in which the proceedings were quashed. Hence, he prayed to quash the proceedings pending against the petitioners.

Learned Government Advocate (Crl.Side) appearing for the first respondent Police submitted that the investigations have been completed, the final reports have also been filed and the same have been taken cognizance before the Judicial Magistrate, Valangaiman, in S.T.C.Nos.20 of 2026, 3 of 2026, 16 of 2026 and 4 of 2026.
5. Heard the learned counsel appearing on either side and perused the materials available on record.

In view of the above, this Court is of the opinion that the above said decisions would apply on all fours to the present case and that no useful purpose will be served by keeping the criminal proceedings pending 4/6 https://www.mhc.tn.gov.in/judis ( Uploaded on: 09/02/2026 03:00:00 pm ) Crl.O.P.Nos.2124, 2129, 2150 & 2152 of 2026 and is liable to be quashed. Further, though the petitions have been filed by the petitioners alone, no useful purpose would be served by allowing the proceedings to continue against the remaining accused, who are all similarly placed, and it is an abuse of process of law.

Accordingly, these Criminal Original Petitions are allowed and all further proceedings pending against the petitioners pursuant to the Crime Nos.83 of 2018, 109 of 2017, 84 of 2018 and 24 of 2018, which have now culminated to S.T.C.Nos.20 of 2026, 3 of 2026, 16 of 2026 and 4 of 2026, on the file of the Judicial Magistrate, Valangaiman, are hereby quashed in their entirety. Consequently, connected Miscellaneous Petitions are closed.
