Information sought

and background of the case:

The Appellant filed an RTI application dated 24.11.2022 seeking information on following points:-

1 "Full copies of the complete file Note-Sheet including copies of the orders, replies, reports, enquiries, correspondence with ICAR legal cell, ASRB, ICAR institute CIRB, Government of Punjab, Vigilance section of ICAR etc. as contained in the personnel file of myself Dr. Inderjeet Singh, while working as Principal Scientist, CIRB, Hisar as Director CIRB, Hisar followed by deputation to Punjab Government as Director Animal Husbandry and presently on deputation to GADVASU, Ludhiana viz for the entire period of my service in ICAR till date.

2 Full copies of the Annual Performance Appraisal Reports of myself Dr. Inderjeet Singh, since 2001-to-date as are available in the record of ICAR and or its institute ICAR-CIRB, Hisar.

3 Full copies of the file pertaining to the representations made by myself Dr. Inderjeet Singh to the ICAR for clearance of probation period and absorption in ICAR as well as the decisions taken thereupon, including related notings Page 1 of 3 on Note Sheet of the concerned file, opinions, orders, letters and other related documents."

The CPIO & Under Secretary(Pers.) Indian Council of Agricultural Research (ICAR), New Delhi vide letter dated 23.12.2022 replied as under:-

"............it is to inform that the matter of appointment of Dr. Inderjeet Singh in the Council is still subjudice in the Hon'ble Court."

Dissatisfied with theresponse received from the CPIO, the Appellant filed a First Appeal dated 05.01.2023 which was not adjudicated by the FAA as per available records.

Aggrieved and dissatisfied, the Appellant approached the Commission with the instant Second Appeal.

Facts emerging in Course of Hearing:

Appellant: Absent Respondent: 1. Smt Adya, SO (Pers- III) and Deemed CPIO;

2. Smt Abhilasha, Assistant The Appellant remained absent during the hearing despite prior intimation. Smt Adya reiterated the reiterated the written submission received from the CPIO and US (Pers), ICAR, HQ, New Delhi vide letter dated 11.03.2024 the relevant extracts of which are as under:

"The applicant's First Appeal dated 12.01.2023 was also disposed of by theFAA vide reply dated 26.04.2023 (Annexure-III) by supplying the photocopies of notesheets of the relevant file ( 36 pages) and also requested Dr. InderjeetSingh to visit, inspect and take extracts of the relevant documents/ files whichare available in Personnel Division as the information sought by the applicantwere voluminous and pertained to different units of ICAR. Further, Dr. InderjeetSingh personally visited ICAR Headquarters on 22.05.2023 (Annexure- IV) forinspection of records and after inspection of records, he has obtained the extractsof the requisite documents (94 pages)."

Decision:

Keeping in view the facts of the case and the submissions made by the Respondent, the Commission is of the view that an appropriate response as per the provisions of the RTI Act, 2005 has been provided. Hence, no further intervention of the Commission is required in the instant matter.

With the above observation, the instant Second Appeal stands disposed off accordingly.
