Section 44(1) in The Bombay Public Trusts Act, 1950
(1)Subject to the provisions of this Act [and] [This word was substituted for the word 'or' by Bombay 14 of 1951, Section 11.] the rules made thereunder the Charity Commissioner may be appointed to act as a trustee of a public trust by a Court of competent jurisdiction or by the author of the trust.
