Order No. 04.09.2024 01. 1. This matter is taken up through Hybrid arrangement
(video conferencing/physical mode).
2. Heard Mr. Gyanendra Chandra Swain, learned counsel appearing for the Petitioner.
3. The Petitioner has filed this Writ Petition seeking for a direction to the Opposite Party No.4 to take proper initiative/effective steps in the matter of disposing the representation dated 21.11.2023 for award of compensation amount in his favour.
4. Learned counsel for the Petitioner submitted that though the representation under Annexure-10 on this issue, is pending with the Additional District Magistrate, (R&R) MCL, Basundhara area, Sundargarh (Opposite Party No.4) since 21.11.2023, no communication has been received from the concerned Authority and a direction may be issued to the Authority for disposal of the same.
5. Learned counsel for the State has no objection to such submission.
6. Considering the submissions made by the learned counsel for the respective parties, without expressing any opinion on the merits of the case, we dispose of the writ petition directing the Additional District Magistrate, (R&R) MCL, Basundhara area, Sundargarh to take a decision on the representation filed by the Petitioner vide Annexure-10 and pass appropriate order in accordance with law within a period of three months from the date of production of a certified copy of this order. The order shall be communicated to the Petitioner by the Additional District Magistrate, (R&R) MCL, Basundhara area, Sundargarh within two weeks of taking the decision.
