Learned counsel for the petitioner submits that the petitioner is a contractual employee and he was appointed by order dated 11-03-2008 (Annexure P-3) and his contract appointment has been renewed from time to time. By order dated 21-07-2017 he was transferred from Block Anooppur, District Annopur to Block Seoni, District Seoni. He challenged the said order in W.P.No.13081/2017. This court in the said writ petition granted interim relief and the matter was disposed of. It is stated that now while deciding the arbitration proceedings, he has been transferred to Multai, District Betul.
Learned counsel for the petitioner submits that the petitioner is a contractual employee and as per the circular issued by the Government dated 01-12-2015 his services could not be transferred.
Considering the aforesaid submissions, till the next date of hearing, the petitioner shall be permitted to work at his present place of posting.
Learned counsel for the State is granted time to seek instructions in the matter.
