2. The Applicants appeared in the tests for the post of Constable (Driver) in Delhi police on the basis of the recruitment for the year 2009 and were provisionally selected for the aforesaid post. They were required to submit their papers, including the driving licence, for scrutiny by the competent authority. As per the advertisement for the post the Applicants were required to be in possession of a valid driving licence for heavy motor vehicle at the time of applying for the post. The Applicants in these OAs have obtained their driving licences from the District Transport Office at Mathura or Agra. After they had submitted their driving licenses, the Applicants received a show cause notice stating therein that the District Transport Officer of Mathura/Agra was asked to verify the genuineness of the driving licenses. The common refrain in all the notices to show cause is that:
"the verification of driving license was got conducted on the basis of depositing fee with their cash section for issuance/endorsement of heavy motor vehicle and found that your driving licence is not valid for driving heavy motor vehicle. Moreover, your address given in the driving license was also found incomplete/incorrect."
It was mentioned thereafter in the notice to show cause that the above facts clearly indicated that the Applicants were not in possession of valid driving license at the time of applying for the post of Constable (Driver) in Delhi Police and that they have sought to seek employment in Delhi Police by adopting deceitful means and tactics in spite of the clear warning given in the application form that furnishing false information in the application form would be a disqualification and would render the candidate unfit for employment under the government. After going through the reply submitted by the Applicants, a standard common order was passed, which reads thus:
I have gone through the reply submitted by you to the show cause notice, but do not find convincing. You were also given an opportunity for personal appearance. Accordingly, you appeared before the undersigned, Delhi on 14/12/2010. The facts explained by you have been examined in details in the light of rules and instructions and same have not been found convincing. At the time of hearing you did not say anything except what you had already stated in your reply to the show cause notice. From the reports/facts of the case, it clearly reflects that you were not in possession of valid and genuine driving licence for driving heavy motor vehicles at the time of applying for the post of Constable (Driver) in Delhi Police and tried to seek employment in Delhi Police by adopting deceitful means and tactics.
I, therefore, confirm the proposed show cause notice and cancel your candidature for the post of Constable (Driver) in Delhi Police and debar you from further employment in Delhi Police.
3. When one of the OAs in the bunch first came up for hearing before a learned coordinate bench of this Tribunal, the following order was passed:
"There seems to be a spade of cases showing that either the candidates might have obtained false licenses or the Transport Department at Mathura /Agra after having received money for issuance of the licenses, may have misappropriated the money and not showing in the register but at the same time, if it is so, the applicants are not at fault and the officers of the Transport Department at Mathura/Agra are at fault. Therefore, we direct Commissioner of Police, Delhi to depute an officer not below the rank of ACP, immediately to Mathura/Agra to search out whatever records available in the office of Transport Department and file an interim report within one week from today relating to this."
4. The officer deputed by the Commissioner of Police gave a report, which, however, does not cover all the cases before us.
5. We have heard arguments in some of the cases. The following order was recorded on 15.04.2011:
"It is not in dispute that at least in 10 matters out of batch of the OAs, reply has been filed and rejoinder thereto is being filed today. Thus pleading are complete and further that the issues involved in all the matters are the same.
List all the bunch of OAs for final adjudication on 26.04. 2011. It is made clear that no further adjournment shall be granted."
6. It appeared to us that facts in each of the cases were different and could not be covered by an omnibus non speaking order passed in each case by the Respondents. The same would apply to the notice to show cause, which would also not cover the facts of each case and thus deprive the candidates of the opportunity to present their side of the case. The notice to show cause and the order passed thereon, as quoted above, do not cover the facts of the cases, yet elaborate and detailed reasons have been given in the counter affidavit to rebut the case of the Applicants. It was urged by the learned counsel representing the Applicants, relying on Mohinder Singh Gill and another V. The Chief Election Commissioner, New Delhi and another, (1978) 1 SCC 405, that the Respondents could not enlarge the reasons for rejecting the case of the Applicants by supplementing the reasons for rejection given in the order by way of an affidavit.

It was also submitted during the course of arguments that none of the points raised in reply to the notice to show cause had been touched upon in the order by which the candidature of the Applicants had been cancelled. Further, the report of the District Transport Officer Mathura/Agra was not given to the Applicants for them to know the reasons why their licences had been considered invalid. It was a common refrain in all the cases that were heard that the Licensing Authority Mathura had already written to the Delhi Police on 03.03.2010 by letter number 255/Licence/satyapan/2010 in response to the Police Headquarters' letter number 1193/Estt. P&L dated 01.02.2010, whereby 200 licenses had been certified to have been validly issued. It was argued that it was not clear why further investigation needed to be made in the case. It was also argued that it was not clear from the show cause notice whether the fee for license was not deposited at the time of initial issue of the license or at the time of endorsement for heavy motor vehicle driving. It was further pointed out that in case of the Applicant Anand in OA number 141/2011 no satisfactory reply had been given in the counter affidavit by the Respondents to the following averment in the OA:
That it is submitted that the averments contained in the show cause notice are vague. From the contents of show cause notice it is not clear as to how the driving license is not valid on the basis of verification conducted on the basis of depositing fee with the cash section of the concerned Licensing Authority. It is not known as to what deficiency or irregularity has been found therein. It is further not known from the show cause notice as to what went wrong at the event of depositing fee and at what stage i.e. stage of issuance or stage of endorsement of heavy motor vehicle. Therefore the show cause notice is bad in law as it does not disclose full facts alleged against the applicant. Further, the show cause notice did not specifically spells out the details as to how and in what manner, the address given in the driving license is found incomplete or incorrect as alleged. It is further not known as to what kind of enquiry has been made to allege that the address was incomplete or incorrect. Not only this, the show cause notice does not even has a mention as to whether the address on the driving license was incomplete or whether it was incorrect.
Further no letter as mentioned in the show cause notice constituting the alleged report has been furnished alongwith the show cause notice, causing further prejudice to the applicant in order to deny him his right to effectively defend the allegations contained in the show cause notice. This is in absolute violation of principles of natural justice. The said reports ought to be furnished to the applicant to make an effective reply. It was pointed out in case of the Applicant Pawan Kumar in OA number 1385 of 2011 that he had deposited cash for issuance of licence and had given an address of Mathura, where he had lived as a student, which could be easily verified. Same averment has been made in respect of the Applicant Manoj Kumar in OA number 493/2011. It was urged in case of the Applicant Surinder Singh in OA number 1393/2011 that he lived in Mathura while serving in the Army and his address was real and verifiable. In case of the Applicant Hari Prakash in OA number 293/2011 also the address at Mathura, where he resided temporarily, has been given in reply to the notice to show cause. However, it has not been considered at all. It was also argued that it would be clear from the reply of the Respondents in OA number 141/2011 in paragraph 5 I that the addresses given in many of the licenses, even though considered to be valid by the Respondents, had been given as cryptically as in the case of the Applicant, without giving all the details. There was no reason why it should not have been considerd to be correct address in the Applicants case. It was argued that in case of Manoj Kumar, the Applicant in OA number 493/2011, the authorities at Mathura itself renewed his heavy motor vehicle license from 23.03.2011 to 22.03.2014 in March 2011 itself. Advertence has been made to the report dated 04.09.2010 from Dr. Rajendra Prasad, Deputy Transport Commissioner, Agra Region, Agra addressed to the Principal Secretary, Transport, Government of UP, which has been placed at pages 59-81 in the paper book in OA number 141/2011 in which, inter alia, it has been mentioned that in respect of the persons mentioned at serial numbers 4, 7, 13, 14, 19, 81 et cetera it has been mentioned in the table annexed to the said report that there were entries in the records regarding issuance of licence, but there were no entries regarding depositing of the fee by the person to whom the license has been issued. It was argued that the Applicants had deposited the fee and if the same had been embezzled by the staff of the Department of Transport, they could not be blamed for the same. It was pointed out that the report of the Assistant Commissioner of Police was also incomplete and did not cover the cases of all the candidates. It appeared from the said report and other documents that parallel records were in existence. In case of the Applicant Manish Kumar in OA number 447/2011, original license had been misplaced and duplicate license had been issued by the concerned authority. In case of the Applicant Ashok Kumar Yadav in OA number 1442/2011, a letter dated 06.07.2010 from the Licensing Officer, Transport Office, Mathura, addressed to one Sadaram S/o Sarjit Singh, VPO-Khera, Nazafgarh, New Delhi reads thus:
Please refer to your letter RTI Act 2005 dated 1.1.10, in this connection it is informed that License No. 15237/MTR/2007 of Sh. Ashok Kumar Yadav S/o Balkishan Yadav issued on 15.11.07 and endorsed as HTV. License 1611.0 is valid from 23.12.98 to 22.12.2011.
License HMV valid for all over India. Documents to substantiate that the above said letter has been dispatched from the Licensing Officer, Mathura have also been placed on record. Another letter dated 08.11.2010 from the Assistant Divisional Transport Officer, Mathura has been placed on record at page 70 of the paper book in OA number 1442/2011 has been reproduced below:
In reference to your letter No.-53311/Rectt. Cell (C-11/PHQ dated 13.4.2010 and this office letter No.-103/DL/Verification/10 dated 3.5.10 on the above cited subject. In this connection, it is intimated that earlier sent list at Sr. No.-61 & 70 marked Ashok Kumar Yadav and Srikant have verified their licences and attend this office personally in which Sh. Ashok Kumar Yadav S/o SH. Balkishan Yadav, License No.-15237/MTR/07 M/Cycle +L.M.V. (Pvt.) + End. H.T.V.+ H.P.V (PE) dated 23.12.08 to 22.12.2011 and Srikant S/o Sh. Kailash Chand License No.-23983/MTR/02 M/Cycle + L.M.V. (Pvt.) + End. HTV + HPV (PE), 31/12/2006 to 30/12/2009 (valid upto) and issued from this office. It was further contended in the OA number 1442/2011 of Ashok Kumar Yadav that the competent authority passed a fresh order dated 27.01.2011 following the directions of this Tribunal in OA number 68/2011 by Ashok Kumar Yadav in which his candidature had been rejected on the fresh ground that the licence number 15237/MTR/07 has been issued in the name of one Anil Kumar and not in the Applicants name. It was urged that this ground was not a part of the show cause notice and, therefore, the Applicant was deprived of the opportunity to reply to this ground.

It is not a case of simply cancelling the candidature of the Applicant, but the order passed by the Respondents has drastic consequences for the future of candidates who appeared in the tests in as much as they have been barred from service in Delhi Police forever. These orders may also affect the defence of the Applicants in criminal cases, which have been filed against them. We are of the view that such order should not have been passed without full fledged inquiry into the facts of each individual case, which, as discussed above, are different in each case. These should not have been decided by one single oninibus non-speaking order.
9. It is not possible for us to go into the facts of all these cases and adjudicate upon the matter. It would be necessary, in the interest of justice, to remand the matter to the Respondents and direct them to issue fresh notices to show cause based on the facts of each case so that the Applicants may have the opportunity to reply to the notice and, after due inquiry, pass a speaking order based on cogent reasons. The notices to show cause and the orders passed thereon are quashed and set aside. We make it clear that we have not gone into the merit of any case and have not made any comments about the merits. The above directions should be complied with within four months from the date of receipt of a copy of this order. The selection of the candidates to the post of Constable (Driver) would abide by the decision taken by the Respondents pursuant to these directions. Needless to say the Applicants will have the liberty to challenge the fresh order passed by the Respondents, if their grievance still survives. There will be no orders as to costs.
