Learned counsel for the parties are ad idem that although the matter could not be compromised before the Mediation and Conciliation Centre, but thereafter the parties agreed to arrive at an amicable settlement, because the parties to the instant litigation are closely related to each other.

Both the learned counsel for the parties are further agreeable that in view of the compromise arrived at between the parties, the present appeal is to be dismissed as withdrawn and the appellants shall deliver the possession to respondent No.1, to the extent of her share as per the compromise.

In view of the abovesaid stand taken by the learned counsel for the parties, present appeal is dismissed as withdrawn. However, it is made clear that the terms and conditions of the compromise arrived at between the parties, shall remain binding on the parties to the litigation.
