I received an envelope from the Secretariat of the Hon'ble the Chief Justice of this Court on 5.6.2012 after close of working hours. The envelope contained a letter dated 16.5.2012 addressed to the Hon'ble the Chief Justice, signed by one Lilabati Sain. She claimed herself to be a member of the Sain family of Burdwan.
Perusal of the letter reveals certain allegations made by the said Lilabati Sain connected to this writ petition and a request has been made to the Hon'ble the Chief Justice to transfer the writ petition from my bench to some other learned Judge for consideration. The letter appears to have been sent to the Hon'ble the Chief Justice by fax from no.26802067.
The contents of the letter are not only defamatory but, in my prima facie view, the said Lilabati Sain is in contempt. Before proceeding further, it is considered necessary to put the said Lilabati Sain on notice.
I request the Director General of Police, West Bengal to cause a thorough enquiry to find out the whereabouts of the said Lilabati Sain. If traced, a copy of this order shall be served on her. The said Lilabati Sain shall be entitled to place her version on 11.6.2012 before this Court, when this writ petition shall be taken up for consideration once again. 2 The Director General of Police may nominate any competent subordinate officer to conduct the enquiry. It would be desirable if the report of enquiry reaches this Court on 11.6.2012.
Registry is directed to inform this order to the Director General of Police immediately together with a copy of the letter dated 16.5.2012 of the said Lilabati Sain, with the contents thereof effaced.
