Heard the Learned Counsel appearing on behalf of the parties. Perused the case diary.

The petitioner is a neighbour of the in-laws family of the victim, who committed suicide by hanging.

We have gone through the case diary, more particularly, through the FIR and other materials collected during investigation, we find the allegation against him is this that he tried to cause disappearance of evidence of the offence.

Having regard to the nature of the allegation if at all the offence committed by him is punishable under Section 201 of the Indian Penal Code, which is bailable.

Having regard to above after detention of the petitioner in custody for 44 days and when no case is made out if the petitioner is released on bail, he is likely to abscond, the prayer for bail is allowed. 2

Let the petitioner be released on bail to the satisfaction of the Learned Additional Chief Judicial Magistrate, Barrackpore, North 24-Parganas upon furnishing a bond of Rs. 10,000/- with two sureties of Rs. 5,000/- each, one of whom must be local.

The application for bail is thus disposed of.
