Background
1. The RTI application was filed on 10.04.2009 seeking information with respect to M/s. P.A. Sales Corporation including Purchase Orders, copies of tenders, extra materials accepted during the period of January, 2005 etc. The PIO replied on 15.05.2009 informing the Applicant that the details of Purchase Orders are available on the ICF website. Being Aggrieved with this reply the Applicant filed his Appeal on 05.06.2009 seeking the information once again. The Appellate Authority replied on 14.07.2009 upholding the decision of the PIO. Still not satisfied the Applicant filed his second Appeal before the Commission on 29.10.2009 seeking complete information.
2. The Bench of Mrs. Annapurna Dixit, Information Commissioner, heard the matter for May 17, 2010.
3. Shri. P. Balan representing the Appellate Authority, Shri. N. Sundar Rajan; PIO (Stores) and Shri. Shiv Kumar, Head Clerk represented the Public Authority.
4. The Applicant was not present during the hearing.
Decision
5. The Commission after hearing both sides holds that the details of contracts given by a Public Authority to an agency can by no means be considered as being held in a fiduciary capacity. Hence, the PIO is directed to open all files related to the M/s P.A. Sales Corporation so that the Appellant may take copies of whatever documents he requires, free of cost. The information may be provided by 15.05.2010.
6. The Appeal is accordingly disposed of.
