The petitioner has challenged the order dated 19.9.2011 (Annexure P3) whereby the application for impleading the petitioner committee as a party has been dismissed.

A suit for mandatory injunction has been filed by Shri Prachin Shiv Shakti Sewa Samiti-respondent No.1 with a prayer for ad-interim relief of installing temporary electricity connection from the electricity department. While disposing C.R. No. 6047 of 2011 [ 2 ] of the application it has been observed that the respondent electricity department has released temporary electricity connection on 16.6.2011 for 6 months against application No. 39434 in the name of Shri Prachin Shiv Shakti Sewa Samiti, New Indira Colony, Manimajra. But due to some dispute the installation of electricity meter was opposed by the opposite party i.e. Samadhi Yog Shiv Sewa Committee. The application has been allowed on the ground that it is a temporary connection and not a regular connection for the smooth running of the temple. The grant of temporary injunction will not tantamount to decreeing the suit of the plaintiff.

No merit. Dismissed.
