 ORDER (ORAL)

By Honble Mr. Navneet Kumar, Member (J) The present Original Application is preferred by the applicant under Section 19 of the AT Act, 1985 with the following reliefs:-

a) To issue of an appropriate order of direction to the respondent No. 4 as contained in Annexure No. 7 to this O.A. that they consider the case of the applicant for appointment on compassionate grounds against the suitable post within reasonable time as early as possible, in the interest of justice.
b) This Honble Tribunal may graciously be pleased to pass any other order or direction which this Honble Court may deem fit and proper under the circumstances of the case.
c) This Honble Tribunal may graciously be pleased to award the cost of the original application to the applicant.

2. The applicant is the son of late Sri Vijay Shankar Trivedi who was working with the respondents organization on the post of GDS. Unfortunately, he died on 27.6.2013 leaving behind his wife and two sons. The applicant is intermediate pass and eligible candidate for the post of GDS in the Department of Post and Telegraph. The learned counsel for the applicant has indicated that the father of the applicant was only bread earner and the applicants family is leaving in penurious condition and application has already been submitted for grant of compassionate appointment. The authorities vide order dated 2.1.2015, also issued a letter to the employment exchange for sending the names for employment. The learned counsel for the applicant has made an innocuous prayer that his request for engagement may be considered by the authorities within a reasonable period of time.

Sri Rajesh Katiyar, learned counsel appearing on behalf of respondents has put in his appearance and has indicated that he has no instructions whether the representation so submitted by the applicant is still pending or it has already been disposed of. He also prays that he may be granted some time to seek instructions.

4. Heard the learned counsel for parties and perused the records.

5. The applicant is the son of deceased employee who died while he was in service. Soon thereafter, a request was made for grant of compassionate appointment to the applicant. The applicant is intermediate pass candidate and claims himself to be eligible for appointment for the GDS post. Apart from this, respondents through letter dated 2.1.2015 has already requested the employment exchange , Raebareily for sending the names for appointment, as such it appears that there are some vacancies.

The prayer so sought for by the applicant is innocuous in nature as such, without entering into merit of the case, I deem it appropriate to issue a direction upon the respondents to consider and decide the applicants representation for grant of compassionate appointment as early as possible and decision so taken be communicated to the applicant. The applicant is also directed to provide the copy of his representation along with copy of this order to facilitate the respondents to take an early decision on his representation.

7. With the above observations , O.A. stands disposed of. No order as to costs.
