1. Heard learned counsel Mr. P. B. Vikhe Patil, holding for Mr. S. J. Salunke, learned counsel for the applicant Sahebrao Ingole (original accused no.5) has suffered a paralysis attack and due to said paralysis attack he has lost partial control of one side of the body. He was admitted for some time as a indoor patient in Ghati Hospital, Aurangbad. Learned counsel submits that due to lack of paucity of funds the medical tests could not be carried out. This successive application is submitted for suspension of sentence and bail and only on the ground of health issue. His earlier application came to be rejected on merits on health issue.

2. In view of same, issue notice to the respondent, returnable on 14/03/2022. Learned APP waives notice for respondent -State.
3. We request the learned APP to take specifc instructions from the jail authority as to the present physical condition of the applicant. We request the learned APP to take instructions on three grounds i.e. I) whether the applicant is getting treatment through jail doctor or otherwise in any other government hospital regularly and continuously II) whether the day today routine of the applicant is affected due to his health issue and III) if it is affected then whether he needs the help for completing his day today routine or that he can perform his daily routine without any help.
