The learned Counsel for the Petitioner states that the impugned order is being challenged in writ jurisdiction of this Court since the Petitioner's request to cross examine the material witness has been denied and therefore, the order is in violation of the principles of natural justice and the same should be set aside, and the proceedings be remanded for reconsideration after giving an opportunity to the Petitioner. The learned Counsel relies on the decision of the Division Bench of this Court in the case of Sameer Shah (Real Name "Javed Shaikh") vs. The Union of India & Anr. 1 which has followed the decision of the Hon'ble Supreme Court.
