3. Present writ petition has been filed seeking a direction to the Respondents to grant the benefit of age relaxation to the Petitioners for participation in the selection process advertised by recruitment notice dated 29.10.2022.

4. Issue notice.

5. Mr. Yashvardhan, learned counsel accepts notice on behalf of Respondent No. 1 and seeks a period of three weeks to file counter affidavit in response to the writ petition.

6. Let counter affidavit be filed within a period of three weeks from today.

7. Rejoinder, if any, be filed within a period of one week thereafter.

8. Ms. Rashmi Chopra, learned counsel appearing on behalf of the Petitioners submits that the last date for submitting the application is 15.12.2022 and therefore, the Petitioners be permitted to apply without prejudice to the rights and contentions of the parties.

9. Reliance is placed on the order dated 07.04.2022 passed by this Court in Poonam and Ors. v. GNCTD and Ors., W.P.(C) 5397/2022, more particularly, para 19 thereof. Reliance in the said order is placed on the judgment of the Supreme Court in University of Delhi v. Delhi University Contract Employees Union and Others, 2021 SCC OnLine SC 256.

10. Accordingly, Petitioners No. 1 and 2 are permitted to apply for the posts of 'Lab Assistant' and 'Store Keeper', respectively. It is made clear that this will not create any equity in favour of the Petitioners and will be subject to the outcome of the writ petition.
