              2.           1.        This matter is taken up through hybrid mode.

2. The Petitioner in this writ petition prays for the following reliefs:-

"In the aforesaid facts and circumstances this humble petitioner fervently prays this Hon'ble Court to admit the writ petition and issue notice to the Opp. Parties asking them as to why a writ of mandamus shall not be issued, directing the 0pp. Party No.5 to conclude the conciliation proceeding immediately or within a short period and submit necessary report before the appropriate Govt. as regards the Form-D dated 16.04.2026, the 0pp. Parties No.2 to 4 may kindly be directed to ensure smooth functioning of the industry and further to direct the Opp. Parties No.l & 2 to declare the strike called by the OP Nos.5 union as illegal & prohibit it, and if they fail to show cause or show insufficient cause then to make such ruling absolute and issue a writ of mandamus as per prayer above;
And may issue a direction/writ in the nature of mandamus to ensure smooth running of the petitioner industry at the observation of the state machineries.
And may pass any further order(s) as may deem fit and proper in the interest of justice and oblige.
And for such act of kindness the humble petitioner as duty bound shall ever pray."

This Court taking note of the submission of learned counsel for the Petitioner directed learned State Counsel to take instruction as to what action has been taken pursuant to issuance of Form-D against the Union with regard to continuance of strike during conciliation proceeding in terms of Sections 62 and 63 of the Industrial Relations Code, 2020.

3.1 In response to the same, the Conciliation Officer-cum- Divisional Labour Commissioner, Bhubaneswar, vide his letter No.3114/JLC, BBSR Range, BBSR dated 5th May, 2026 intimated the office of the learned Advocate General that in the conciliation meeting held on 22nd April, 2026, the Union members/workers agreed to resume their normal duties. Accordingly, the workers have already resumed their normal duties with effect from 22nd April, 2026. The Management has also confirmed the same vide its letter dated 5th May, 2026, a copy of which is enclosed to the instructions imparted by the Conciliation Officer. Copy of the said written instruction is taken on record.

Keeping in mind that the workers have already resumed their normal duties with effect from 22nd April, 2026 (2.00 PM), this Court disposes of the Writ Petition with a direction to the Conciliation Officer to conclude the conciliation proceeding expeditiously in accordance with law. Relief sought to declare the strike illegal can be raised by the industrial adjudicator, if a reference is made in that regard.
