Heard learned counsel for the petitioner and the counsel for the Bank, who prays for time to file counter affidavit, but in view of the nature of the order, which this Court is proposing to pass, does not admit of any counter affidavit. In the circumstances, request of the learned Senior Counsel to grant time to file counter affidavit is rejected.

2. Petitioner was posted as Inspecting Officer in July, 2008. He has filed this writ application for a direction to the Respondent- Bank and its functionaries to consider his case for posting in any particular Branch or office, as his health does not permit him to undertake extensive touring job, which is required to be undertaken as Inspecting Officer. In this connection, it is submitted that petitioner is to superannuate in May, 2011 and his general health is not satisfactory as would appear from the certificates contained in Annexures-2 and 3 series, which begins from the year 2007 and the last certificate is dated 21.9.2009. In this connection, petitioner has also 2 represented before the Chairman of the Bank giving graphic description of the ailment suffered by him, as he is also passing blood through his urine.

Having heard counsel for the petitioner and the Bank and having perused the contents of the representation dated 23.4.2009 along with medical prescriptions and certificates, Annexure-2 series, I am of the view that the Chairman of the Bank should consider the request of the petitioner to grant him any static posting on a post commensurate to his status in accordance with law, as early as possible, in any case within one month from the date of receipt/ production of a copy of this order taking into account the fact that such postings have been allowed to others on medical grounds.

4. This writ application is, accordingly, disposed of.
