By means of this petition, the petitioner has prayed for issuance of writ in the nature of Mandamus directing the opposite parties no. 1 to 3 to ensure removal of illegal encroachment made by the respondents no. 4 to 6 over Gata No. 603 (Old Gata No. 1524) measuring area 0.413 hectare situated at Village - Khorhasa, Police Station - Kotwali Dehat, Pargana, Tehsil & District - Gonda.
Instructions filed today is taken on record.
Learned State Law Officer on the basis of instructions has submitted that an inquiry was conducted by the revenue officials and upon inquiry it was found that there is no illegal encroachment on the land in question and the said Gata is lying vacant at present.
On the perusal of records, this Court is satisfied with the submission of the learned State Law Officer and apparently there seems to be no encroachment. In any case, the revenue authorities arrived at a decision, thus, rendering the present petition infructuous. Apparently, there is no representation from the side of the petitioner and it seems either the petitioner is not interested to pursue the present writ petition or the cause for filing the present petition does not survive.
In view of the above, the present writ petition is disposed of.
