This is a petition filed under Section 439 of the Code of Criminal Procedure seeking regular bail in a case registered against the petitioner vide FIR No. 73 dated 10.08.2011 under sections 399, 402, 365, 341, 342, 332, 353, 307 IPC and section 25 of the Arms Act at Police Station Mohana, District Sonepat.
Learned State counsel has apprised the court that out of 16 prosecution witnesses cited, 7 have already been examined and 5 have been given up. Remaining 4 witnesses will most likely to be examined on the next date of hearing i.e. 10.04.2012. Similar is the report received from the trial court.
In view of above, there is no ground made out to enlarge the petitioner on bail at this stage as trial is likely to culiminate soon. Dismissed.
Petitioner shall, however, be at liberty to file afresh in case trial is not concluded within three months.
