1. The Applicants in the Original Applications Nos.114 of 2020 (SZ) to 122 of 2020 (SZ) are the Review Applicants in all the above Review Applications which are directed against the order passed in Original Applications Nos.114 of 2020 (SZ) to 122 of 2020 (SZ) dated 15.09.2022.
Page 16 of 202. The Review Applicants have raised various grounds in the Review Applications alleging error apparent on the face of the record.
3. The Review Applicants have contended that, 3.1 The activity of the prawn/shrimp culture is a prohibited activity on the fertile lands as per S. Jagannath Vs. Union of India & Ors. 1 According to the Review Applicants, the lands where the prawn/shrimp culture is carried out by the respondents are fertile lands and it requires regulation, as the fertile land cannot be converted into a pond for prawn/shrimp culture. Once the land is converted for the operation of prawn/shrimp culture, the salinity of the soil would increase and the land becomes unfit for agriculture. The above said point has not been considered by the Tribunal.
The said aspect has been considered by this Tribunal in Para (61) of its Judgment and held that necessary permission from the Coastal Aquaculture Authority by following the procedure provided therein should be obtained by the prawn/shrimp farmers and any activity without obtaining such permission would be deemed to be an unauthorized act.
3.2 The inspection conducted by the Joint Committee is in violation of Section 11 of the Environment (Protection) Act, 1986, as the Joint Committee had not followed the procedures laid down under Section 11 of the said Act. The objection of the Review Applicants is that the Agriculture Department had conducted the inspection after a period of two years from the date of filing of the Original Applications and that the Tribunal had not considered the independent reports filed by the authorities, wherein it had been stated that the agricultural activities have been enormously decreased because of the rampant illegal aquaculture farms in the regions.
1AIR 1997 SC 811 Page 17 of 20 Even presuming that the Tribunal had followed the Joint Committee report alone, it will not amount to an error apparent on the face of the record. In fact, the Original Applicants have categorically stated that they were not doing the agricultural activity for a long time in the property and had not adduced any evidence to show that what was the condition of the land originally and what was the reason for not doing the agricultural activity by them and how the aquaculture activity had harmed their lands.
Hence, in the Judgment, it was held that the entitlement of compensation for agricultural loss is based on the material evidence for paddy cultivation earlier by the committee in force and after assessing the agricultural loss during the disaster. The Tribunal has categorically held that while assessing the compensation in respect of the applicant in O.A. No.114 of 2020 (SZ), the committee in existence in that district to assess the agricultural loss during the disaster and to ascertain whether the water from those irrigation tanks has been utilized for irrigation at that time and what would have been the impact on the fertility of the land and the production capacity.
Therefore, the Review Applicants cannot have any grievance that it is only based on the Joint Committee report, the above said findings were given.
3.3 The Tribunal had not invoked the 'Polluter Pays' principle in the Judgment. According to the Review Applicants, the loss suffered by the farmers and the applicants due to rampant illegal aquaculture farms was not considered by the Tribunal.
In Para (74) of the Judgment, it has been categorically stated that the compensation will have to be calculated based on the formulae evolved by the Central Pollution Control Board (CPCB) as directed by the Principal Bench of National Green Tribunal in Paryavaran Suraksha Page 18 of 20 Samiti & Anr. Vs. Union of India & Ors.2 and directed the State Pollution Control Board to make the calculation of environmental compensation on the basis of the formulae evolved by the CPCB and take steps to recover the amount from the persons who are responsible for the same in accordance with the law. Therefore, the said contention also does not stand for consideration.
The Tribunal has already directed the State Pollution Control Board to identify the unauthorized aquaculture farms which have been established in the unauthorized zone or encroaching into the Government land without obtaining permission and calculate the compensation amount after affording an opportunity to the parties by issuing a show cause notice. Therefore, the said allegations are also not sustainable.
4. On going through the allegations, since the Tribunal felt that there is no necessity for further hearing, it was decided to dispose of all these review applications by circulation.

As the Review Application cannot be used for re-agitating the issues which had already been heard and considered in the absence of any error apparent on the face of the record, the same cannot be entertained. These Review Applications are nothing but a reiteration of the argument already raised and considered in the main order.
6. Time and again, it has been held that filing of a Review Application has to be deprecated as an attempt for rehearing the matter again on merits. In this case, particularly, the Tribunal had given various directions in detail to the concerned authorities to consider the violations alleged in the applications and take appropriate actions. Merely because the compensation payable is not ascertained and reported in the Joint Committee report, the same cannot be revisited in a Review Application.

In this regard, Point (VII) of the operative portion of the Judgment in Para (82), the Tribunal has specifically directed the Central Pollution Control Board to explore the possibility of bringing the aquaculture farms under the consent mechanism as has been done in respect of poultry farms, considering the quantity of waste that is likely to be discharged and the possible pollution that is likely to be caused. Further, the Central Pollution Control Board was also directed to consider the said aspects and issue necessary guidelines or directions for regulating such activities.
8. Therefore, there is no necessity for reviewing the well considered Judgment in the absence of any error apparent on the face of the record.
9. Hence, all these Review Applications are dismissed.
