ORDER
Facts:
1. The appellant filed RTI application dated 26.06.2017 seeking information regarding: copy of enclosures along with letter dated 20.02.2009 w.r.t transfer of his wife Smt. Charu Singh; leave record, medical certificate submitted by Smt. Charu Singh, etc.
2. The appellant filed second appeal on 29.12.2017 with the Commission on the ground that information should be provided to him.
Hearing:
13. The appellant was personally present in the hearing. The respondent, Sh.
M. Ramadas, CPIO participated in the hearing through VC. Sh. Anshuman Misra, APIO, Dehradun along with Sh. B S Negi were personally present in the hearing.
4. The appellant referred to his RTI application dated 26.06.2017 and stated that the information has been wrongly denied to him by the respondent.
5. The appellant stated that complete information should be provided to him as it is required to be submitted before the court of law. The appellant alleged that his wife had filed a false criminal case before the Court and the documents sought by him in his RTI application are required to prove his innocence.
6. The respondent stated that they are agreed to provide copy of letter dated 20.02.2009 written by the appellant but enclosures cannot be provided to him as those enclosures are the personal documents of the third party. The respondent stated that after thorough search of their records, they have not found any letter dated 17.12.2008 in the personnel file of Smt. Charu Singh as sought by the appellant on point no. 2 of his RTI application. The respondent stated that the information sought by the appellant on point no. 3 (regarding leave record, medical certificate of Smt. Charu Singh) is personal information of the third party. The respondent stated they have also invoked Section 11 of the RTI Act but Smt. Charu Singh, in writing, denied providing any information to the appellant. The respondent stated that the information sought by the appellant on point no. 4 (regarding documents related to food poisoning case, etc.) has been weeded out as per their policy.
7. The appellant stated that contradictory reply has been given by the respondent on point no. 2 of his RTI application.
Discussion/ observation:
8. The Commission is of the view that the respondent should provide to the appellant letter dated 20.02.2009 (as sought by him on point no. 1 of his RTI 2 application) and to give specific reply to the appellant on point no. 2 of his RTI application.
Decision:
9. The respondent is directed to comply with para no. 8 above, within 15 days from the date of receipt of this order. The appeal is disposed of. Copy of the decision be given free of cost to the parties.
