Haryana Public Service Commission and another ...Respondent(s)

CORAM: HON'BLE MS. JUSTICE RITU BAHRI.

Present: Mr. Akshay Jindal, Advocate
            for the petitioner.

            Mr. Kanwal Goyal, Advocate
            for respondent No.1.

RITU BAHRI, J. (Oral).

By this petition, the petitioner is seeking direction to respondents to interview him for the post of Assistant Professor (Geography) pursuant to letter dated 04.08.2017 (Annexure P-5).

Vide order dated 30.08.2017, notice of motion was issued by observing that petitioner had not been called for interview on the ground that he had obtained degree from Karnataka State Open University and the question of de-recognition of the University was still pending before the University Grants Commission ('UGC' in short).

After notice of motion, reply was filed by respondent No.1. The stand taken by respondent No. 1 is that as per interview letter dated 04.08.2017 (Annexure P-5), petitioner was required to produce all his documents and it was found that he had done his post graduation from Karnataka State Open University and vide certificate dated 04.08.2017 1 of 2 ::: Downloaded on - 02-02-2020 23:40:50 ::: CWP-19568-2017 - 2- (Annexure P-9), issue regarding de-recognition of the University is pending in UGC, New Delhi. In this backdrop, University did not issue Provisional Pass Certificate and Convocation Certificate to the petitioner.

Since no approval has been granted by UGC till date to the University, the candidature of the petitioner had been rightly rejected being ineligible. It is not the case of the petitioner that recognition had been granted to the Karnataka State Open University by the UGC after certificate dated 04.08.2017 (Annexure P-9). Further final result to the post of Assistant Professor (Geography) has been declared in the month of November, 2019 and all candidates have already joined.

Keeping in view above, writ petition is dismissed.
