2 02-08-2019Heard learned counsel for the petitioner.
This application under Article 227 of the Constitution of India has been field by the petitioner challenging the order dated 01.03.2019 passed by the learned Sub-Judge-cum-ACJM, Ballia, Begusarai in Title Suit No.76 of 2004 by which he has allowed the petitioner for amendment filed by the plaintiffs under Order 6 Rule 17 of the Code of Criminal Procedure, 1908 (for short 'CPC').
It has been submitted by the learned counsel for the petitioner that by allowing the amendment petition dated 20.02.2019 filed under Order 6 Rule 17 of the CPC, the trial court has allowed to amend a time barred pleading. The trial court has held that by this amendment only numbers in the plaint has to be amended which are formal in nature, but it had failed to appreciate that the effect of allowing amendment shall be fatal. It has also failed to appreciate that in partition suit, partition was demanded only for schedule-I property along with declaration of title for the same. The entire suit continued on the basis of that schedule-I property. No application seeking Patna High Court C.Misc. No.503 of 2019(2) dt.02-08-2019 5/5 amendment in the plaint was filed either at the stage of filing of written statement or framing of issues or evidences adduced on behalf of the parties but, belatedly, at the stage of argument, when the argument had already taken place on many dates, application for amendment was filed, which would change the entire nature of the suit, as the effect would be that apart from schedule-I property, the plaintiff would start demanding partition over schedule-III and IV properties also, for which, no evidence was ever led by either the plaintiff or the defendants.
Issue notice to the respondents 1st set by ordinary process as well as registered cover with A/D, for which requisites etc. must be filed within one week, failing which the application shall stand dismissed without further reference to a Bench.
Put up after the service report is received. In the meantime, further proceedings in Title Suit No.76 of 2004 pending in the court of Sub-Judge-cum-ACJM, Ballia, Begusarai shall remain stayed.
