Section 88 in Madras Hindu Religious and Charitable Endowments Act, 1951

88. Cost of proceedings, etc.

(1)The costs, charges and expenses of and incidental to any suit, appeal or application to a Court under this Act shall be in the discreation of the Court, which may, subject to the provisions of section 77, direct the whole or any part of such costs, charges and expenses to be met from the property or income of the religious institution or endowment concerned or to be borne and paid in such manner and by such persons as it thinks fit.
(2)The costs, charges and expenses of and incidental to any appeal application or other proceedings before the Commissioner or a Deputy Commissioner shall be in his discreation and he shall have full power to determine by whom or out of what funds and to what extent such costs, charges and expenses are to be paid; and the order passed in this regard may be transferred for execution to the Court and shall be executed by the Court as if the order had been passed by itself if and in so far as the Court considers the order to be a reasonable one.
