Information sought:
The Complainant filed an RTI application dated 23.03.2023 seeking the following information:
"Kind attention- MES, Agra. Sir, Please furnish the following information regarding the road from Military Diary Farm, Gwalior Road to COD Gate Chawli District Agra-
1. List of tenders, their estimated cost, their bidding amount, name of bidder to whom tender was awarded for the repair, re-construction, renovation of the aforesaid road since financial year 2015-16.Page 1 of 3
2. Copy of inspection note/note/letter, etc. received for the repair, re- construction, renovation of the aforesaid road since financial year 2015-16.
3. Copy of any complaints, if any, received regarding quality of road constructed and action taken thereof.
4. Is there any proposal for widening the above mentioned road, if yes, please furnish the copies of the correspondence letters?
5. Is there any proposal for making footpath along the road, if yes, please furnish the copies of correspondence letters?
6. Is there any provision for plantation along side the road under MES, if yes, please furnish the copy of the same.
7. What is the reason for not installing the street light on that road? Please furnish the copy of note/letter/correspondence made regarding the same."
The CPIO furnished a point-wise reply to the complainant on 13.05.2023 stating as under:
"Para (1): Repair of roads from Subhash Chowk to Gwalior road was carried out in the year 2022-23 and the contract was awarded to M/s CP Singh and Co. for an amount of Rs. 3687700.00 pl.
Para (2): No Para (3): The subject road is primarily used by civilian defense employees of COD, user unit i.e. COD obtained the sanction of work through proper channel. Para (4): No such proposal has been received by concerned user unit. Para (5): There is neither a proposal for provision of footpath nor has this office received any sanction for the same.
Para (6): There are no provisions existing in scope of road works for plantation of trees along side of road by the MES.
Para (7): Reason and details for non-installation of street lights may please be obtained from concerned office as the same does not fall under AOR of this office."
Being dissatisfied, the complainant filed a First Appeal dated 18.05.2023. The FAA order is not on record.
Page 2 of 3 Feeling aggrieved and dissatisfied, complainant approached the Commission with the instant Complaint.
Relevant Facts emerged during Hearing:
The following were present:-
Complainant: Absent.
Respondent: Absent.
Both the parties remained absent despite service of the hearing notice.
Decision:
The Commission after perusal of records observes that though a sufficient reply qua the instant RTI Application has been provided by the Respondent, yet it is noted that the Respondent has neither appeared before the Commission nor has informed the Commission regarding the reason for his/her absence. Thus, the Commission takes grave exception to the absence of the PIO during the hearing despite being served the hearing notice and he/she is admonished for the same. No further intervention of the Commission is required in the instant matter.
The Complaint is dismissed accordingly.
