Information sought:
The Appellant sought to know the status of compliance of CIC order no. CIC/MP/A/2016/001652 dated 19.01.2017 by Directorate General, Akashwani, New Delhi.
Grounds for the Second Appeal:
The CPIO has not complied with the order of the FAA.
Relevant Facts emerging during Hearing: The following were present:-
Appellant: Present through VC.1
Respondent: Subodh Kumar, PS & Rep. of Consultant (RTI Cell) & CPIO and H.P. Sen, DR to IC (DP) & CPIO, Central Information Commission, New Delhi present in person.
Appellant stated that he has now received the information directly from the concerned public authority and does not want any intervention of the Commission in the matter.
H.P. Sen, DR to IC (DP) & CPIO submitted that he could not comply with the directions of FAA as it was not received by him and it has come to his knowledge only after receipt of hearing notice.
Decision In view of Appellant's statement, no further action is warranted in the case as regards the information sought. However, Commission observes that even as the FAA is directing H.P. Sen, DR to IC (DP) & CPIO to provide information, the order has not been marked to the said CPIO. FAA is directed to remain careful in future.
The appeal is disposed of accordingly.
