Heard on the question of admission.
2. The present OA has been filed by the applicant seeking following reliefs:
"8(I) Modify the impugned office order No.42 of 2025 dated 28.07.2025 issued by respondent No.3. (II) Direct the respondent to grant Non Functional Selection Grade Upgradation of Grade Pay Rs.5400/- to applicant from the relevant dates of Reviewed DPC orders dated 31.07.2024. (III) Pass any such further orders, directions or reliefs as this Hon'ble Tribunal deems fit and proper in the interest of justice, equity and good conscience."
3. It is the case of the applicant that he has promoted as Income Tax Officer, Group 'B' (Gazetted) w.e.f.

It is submitted that the department has issued impugned order dated 28.07.2025 (Annexure A-1). 3 OA No.79/2026 However, in the said order, the name of the applicant is not included. Therefore, representation dated 01.09.2025 (Annexure A-5) and reminder dated 09.10.2025 were submitted to the respondents. However, till date, no decision has been taken by the respondents either extending the benefit or considering the claim of the applicant.
4. On the basis of advance notice, Shri Bhaskar D. Pandit, learned counsel appears and submits that he has no objection so far as consideration of representation is concerned.
