Heard learned counsels for the petitioners and the State.

The petitioners are apprehending arrest in a complaint case wherein process has been directed to be issued after cognizance being taken under section 420 of the Indian Penal Code.

The prosecution case is that the informant being a doctor received an extortion call through mobile.

It is submitted by the learned counsel for the petitioners that the FIR was lodged against unknown but name of the petitioner sprang up during investigation and even assuming Patna High Court Cr.Misc. No.55759 of 2015 (2) dt.16-12-2015 2/2 the accusation no offence under section 387 IPC is made out. Petitioner is a block teacher.

The aforesaid facts constitute ground for consideration of the prayer for regular bail of the petitioner by the learned court below in case the petitioner surrenders within six weeks from today in connection with Complaint Case No. 9955 of 2014 pending in the court of learned CJM, Madhubani.

This application is disposed of with the aforesaid observation/direction.
