Prima facie, it appears that the order impugned has to be set aside. It will be open to the opposite parties to show case why the order impugned should not be set aside and the opposite party no.1(a) should not be directed to be substituted in place of the deceased plaintiff and the other heirs of the deceased plaintiff arrayed as defendants to the suit.
