Section 40(2)(a) in The Mines Rules, 1955

(a)It shall be the duty of the owner, agent or manager to see that adequate and suitable arrangements are made for the speedy removal from the mine to a dispensary or hospital, of persons employed in the mine who while on duty suffer from serious bodily injury or illness of a serious nature.
