Previously, this O.A. was heard along with O.A.No.108/2021 and six other O.As. but vide order of even date passed therein this O.A. has been segregated and has been directed to be placed for order separately.
The O.A. is at notice stage hearing. Learned counsel Shri M.P. Dixit, appearing for applicant submits that applicant comes within "Protected Deemed" category and in spite of that his name is there in the list for proposed transfer and now transfer order has also been passed and applicant will be relieved anytime. He submits that in identical matter namely, O.A.108/2021 etc. which are at the stage of final hearing, this Tribunal, after part argument has granted ad- interim stay and has deferred the further hearing for 30.07.2021. He requests that same ad-interim relief, as has been granted in O.A.No.108/2021 may be granted in this case also. Learned counsel for respondents though do oppose the interim relief but concedes that O.A.108/2021, wherein issue is of valid spouse, after part hearing has been adjourned to enable the respondents to produce the documents wherein criteria for "Protected Deemed" category has been given. He also admitted that ad-interim relief till next date has been granted in O.A. No.108/2021.
Considered the submission. Let issue notice. Service of notice is waived of by Shri G.K. Agarwal, learned counsel for respondents. Respondents are directed to file written statement within Three weeks.
The implementation of impugned proposed/Revised transfer list under ATD 2020-21, as it relates to applicant is stayed till next date.
